This Privacy Notice applies to information that Drover AI and/or its affiliates (“we”) collect when you use our website, products and services (collectively, our “Services”). This Privacy Notice is intended to help you understand what data we collect, why we collect it, what we do with it, and your options regarding our collection and use of that data.

Your access to and use of our products and website constitutes acceptance of this Privacy Notice and consent to Drover’s collection and use of your information as outlined below.

Please note, if you interact with an Internet-connected device (“Operator”) using our Services, that property will have its own privacy notice and practices. You will need to refer to user’s privacy notice for information about their data collection and use practices. Drover AI does not have access to any of its Operator’s end user information.

Information We Collect and How We Use It

‍Personal information is information that can be used to directly or indirectly identify you. Personal information also includes anonymous information that is linked to information that can be used to directly or indirectly identify you. Personal information does not include information that has been irreversibly anonymized or aggregated so that it can no longer enable us, whether in combination with other information or otherwise, to identify you.

Information you provide: We may collect the personal information you provide—such as your name, username, email address, phone number, or mailing address—when you use our products and services, create an account, contact us, apply for employment, sign-up to receive our marketing communications, interact with us at in-person events, or otherwise interact with us.

Information about payments: Payment is required for some of our Services, and we may ask you to provide certain personal information, including your name, address, email, and credit card information, in connection with processing your transactions. All credit card processing for our Services is handled directly by our third-party payment provider (and any information you provide to the payment provider is governed by its privacy policy).

Information about use of our website: When you visit or interact with our website, we may automatically collect certain information about your browser and your interaction with our website, including (a) IP address, (b) browser and device type, (c) operating system, (d) referring web page, (e) the date and time of page visits, and (f) the pages accessed on our websites. We also use cookies and similar technologies to recognize and improve your use of our website. Information from PathPilot: We do not control or process personal information of Operator’s end users. The PathPilot does automatically collect other, non-personal information, including (a) limited front-facing camera imagery, (b) limited location and usage data, (c) a randomly generated ID, (d) accelerometer data, (e) detected road feature data, and (f) license plates in public spaces. How We Use the Information We Collect

We may use personal information for the purposes described in this Privacy Notice. Generally speaking, we use personal information to provide, improve, develop, and personalize your experience with our products and services, to communicate with you, to offer you targeted advertisements and services, and to protect us and our users. We may do so with your consent, for compliance with a legal obligation, for the performance of a contract with you, or for our legitimate interests. Drover AI collects, processes, and determines how to process your personal information as data controller for the following purposes:

Providing, improving, developing, and personalizing your experience with our products and services: We may use personal information to help us provide, improve, develop, and personalize your experience and our Operator’s end users’ experience with our products and services. This includes using personal information for purposes such as data analysis, research, and audits. We may perform such processing based on our legitimate interest in offering you products and services and for business continuity.

Communicating with you: We may use personal information to communicate with you about important notices, including notices related to our products, services, transactions, or changes to our policies and terms. Such processing is based on our legitimate interest in interacting with you to provide you with our products and services. We may also use personal information to communicate with you about your employment requests. Subject to your prior express consent, we may use personal information to send you marketing communications in relation to Drover AI’s own products and services, and we may share your personal information with third-party partners who may send you marketing communications in relation to their products and services. If you no longer wish to receive email communications for marketing purposes, please Contact Us to opt out. We may use your information to process and respond to your requests when you contact us.

Promoting safety and security: We may use personal information to help verify accounts and user activity, as well as to promote safety and security. Such processing is based on our legitimate interest in helping to ensure the safety of our products and services.

When We Share the Information We Collect with Third Parties

We are a global company and may store or transfer your personal information outside both inside and outside of the United States. Certain countries where data is processed may have data protection laws that differ from those in your country. Data transfers outside of the European Economic Area are subject to appropriate guarantees, especially contractual, technical and organizational guarantees, that comply with applicable regulations relating to the protection of personal information. We will not transfer personal information outside of the European Economic Area unless the recipient is subject to suitable safeguards to ensure that the personal information is processed in accordance with applicable law.

Service Providers. We may share personal information with companies that provide services on our behalf, such as website hosting; email services; marketing; advertising; payment processing; data analytics; cloud storage services; employment management; and other services that assist in providing or selling our products and services.

Corporate Affiliates and Corporate Business Transactions. We may share personal information with all Drover AI-affiliated companies. In the event of a merger, reorganization, acquisition, joint venture, assignment, spin-off, transfer, or sale or disposition of all or any portion of our business, including in connection with any bankruptcy or similar proceedings, we may transfer any and all personal information to the relevant third party.

How We Protect Your Personal Information

We implement security measures to protect your personal information against unauthorized access, use, or disclosure which includes physical, administrative, and electronic safeguards. For example, Drover AI is a member of the U.S. Commerce Department’s National Institute of Standards and Technology, which regularly provides updated standards and best practices around IoT device and cybersecurity and encryption. All data sent to our secure servers is sent over a TLS connection using MGTT or HTTPS protocols, so it is secure by default in transit.

Please be aware that, despite our efforts, no security system is impenetrable. In the event of a security breach, we will promptly notify you and the proper authorities if required by law.

Your Rights Concerning the Information We Collect

We take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date. Depending on where you live, you may have the rights described below.

You have the right to access, correct, or delete the personal information that we collect. You are also entitled to object to or restrict, at any time, the further processing of your personal information. You have the right to receive your personal information in a structured and standard format. You may lodge a complaint with the competent data protection authority regarding the processing of your personal information.

To protect the privacy and the security of your personal information, we may request information from you to enable us to confirm your identity and right to access such information, as well as to search for and provide you with the personal information we maintain. There are instances where applicable laws or regulatory requirements allow or require us to refuse to provide or delete some or all of the personal information that we maintain.

You may Contact Us to exercise your rights. We will respond to your request in a reasonable timeframe, and in any event in less than 30 days.

Your rights under the California Consumer Protection Act (CCPA)

The California Consumer Privacy Act of 2018, California Civil Code Sections 1798.100 et seq. (“CCPA”) affords certain rights to you if you are a California resident. This CCPA Notice supplements the information contained in this Privacy Notice and applies to residents of the State of California.

California consumers have the following rights:

  • access—twice in a 12-month period—the categories and/or specific pieces of personal information we have collected about you, the categories of sources from which the personal information is collected, the business purpose for collecting the personal information, and the categories of third parties with whom we share personal information, for the 12-month period prior to the request, free of charge; and
  • delete personal information under certain circumstances.

Drover AI does not discriminate against users or customers on the basis of their exercising any of their rights afforded by the CCPA, which is further in accordance with California residents’ rights under that statute.

To request access to your personal information or request that we delete your personal information, you may contact us through any of the following methods:

To protect your personal information, we will verify your identity using the data points you have previously provided to us. Please have this information available so that we can verify your request.

Upon your request, we will delete the personal information we have collected about you, except for situations where specific information is necessary for us to: provide you with a good or service that you requested; perform a contract we entered into with you; maintain the functionality or security of our systems; or comply with or exercise rights provided by the law. The law also permits us to retain specific information for our exclusively internal use, but only in ways that are compatible with the context in which you provided the information to us or that are reasonably aligned with your expectations based on your relationship with us. If we cannot grant your deletion request, we will specify the basis for denial.

You may also authorize an agent to submit a request on your behalf, so long as you provide the authorized agent written permission signed by you to make a request on your behalf, and your authorized agent additionally is able to verify their identity with us.

Law Enforcement and Transparency

It may be necessary—by law or as a result of legal process, litigation, or requests from public or governmental authorities within or outside your country of residence—for us to disclose personal information.
